now that he's voted to uphold this law, would you still knowing what we know now, nominate a justice like john roberts? >> well, i certainly wouldn't nominate someone who i knew was going to come out with a decision that i rehemently disagreed with. >> joining me now is jeffrey toobin. voting for the united states senator is the number one reason to vote for them since they confirm these nominations. i just want to show you a moment that just occurred in the massachusetts senate debate tonight between scott brown and elizabeth warren. let's listen to that. >> who's your model supreme court justice? >> let me see here. that's a great question. i think justice scalia is a very good judge. justice kennedy. the i think they're very qualified people there. >> >> miss warren who would be your model supreme court justice. >> i think it would probably be elena kagan. >> jeff toobin, it seemed elizabeth warren got that right the first time. we saw scott brown move from left to right. >> it looked like he was sort of randomly picking names out of the sky. the justices who had absolutely nothin

the issue of sensible gun laws. the first presidential debate took place a short distance from aurora, colorado. a victim had a message for the candidates in an ad that airs during the debate. >> this past summer in a movie theater in colorado, i was shot. shot in the face and neck. but i was lucky. in the next four years, 48,000 americans won't be so lucky because they will be murdered with guns in the next president's term. enough to fill 200 theaters. when you watch the presidential debates, ask yourself, who has a plan to stop gun violence? let's demand a plan. it didn't get an area. joining us is comedian chris. john warner and rebecca, contributor to the magazine. i feel of two minds about the debate. focus is good. depth is good. i was appreciative they allowed depth on the issues they talked about, but frustrates there's only so many of these. one is foreign policy. in terms of domestic policy, the next debate is basically it and the vice president debate. i feel there's a lot of stuff i want to hear them on

i think if a president could sign a law that said we will create more jobs that law would have been signed a long time ago. >> well i think he is looking at the fundamentals that are keeping people from hiring like the costs and taxes in obama care. like the over regulation that is stifling small business. like the constant talk of new taxes on small business. i think he is saying we're going to stop that. we're going to stop the over regulation. we're going to stop the taxes. we're going to get this economy jump-started. we're going to open markets in trade in central and south america where we have real opportunities. but on the tax reform, i think it is important that he is pretty bold in his specifics in saying he is going to limit upper income people's ability to get all the deductions. but he is not going to do it on the middle class. i think he has been specific and i think that's just been kind of glossed over. >> let me fill in some blanks here. he has said he is going to get rid of the estate tax though and he has said that he is not going to raise the rate on nonincome from -- o
